1. Service Description

Important: All proxy servers provided through our API are sourced from third-party providers. We do not own, control, or operate the proxy servers. We obtain all proxies from external platforms and resell them through our API service. proxy-free.com provides a proxy list API service with three flexible plans: • **Starter Plan**: $1 per month with 100,000 API calls • **Professional Plan**: $3 per 3 months with 350,000 API calls • **Enterprise Plan**: $12 per year with 1,500,000 API calls All plans include access to our Proxy List API and Proxy Checker API with the respective combined quota per billing cycle. Our service acts as a reseller, aggregating proxy servers from various third-party providers to offer you a comprehensive proxy solution. By subscribing to our Service, you understand and agree that:

• You are responsible for all activities conducted through your use of our proxy API service.
• You will use our Service in compliance with all applicable local, state, national, and international laws and regulations.
• You will not use our Service for any illegal or unauthorized purpose.
• You understand that API usage is limited based on your selected plan: 1,000,000 calls (Starter), 3,500,000 calls (Professional), or 15,000,000 calls (Enterprise) combined for Proxy List API + Proxy Checker API per billing cycle.
• We reserve the right to terminate or restrict your access to our Service at any time, without prior notice, for any reason, including if we believe that you have violated these Terms.

2. Billing and Payment

Our proxy list API service is offered with three pricing options: • **Starter**: $1 USD per month (monthly purchase) • **Professional**: $3 USD per 3 months (quarterly purchase) • **Enterprise**: $12 USD per year (annual purchase) Payment processing is handled through our secure payment gateway.

• Plan-Based Purchase: Each plan requires separate payment transactions based on the billing cycle - this is not an auto-renewal subscription service.
• No Auto-Renewal: Service does not automatically renew. You must manually purchase access for each month.
• Payment Method: All payments are processed securely through our payment gateway.
• Currency: All prices are listed in USD and charged accordingly.
• Service Period: - Starter: 1 month access with 1,000,000 API calls - Professional: 3 months access with 3,500,000 API calls - Enterprise: 12 months access with 15,000,000 API calls
• Service Expiration: Access terminates at the end of your selected plan period after payment confirmation.

3. Acceptable Use Policy

When using our proxy list API service, you agree not to:

• Spam: Use our proxies for sending unsolicited commercial communications, bulk emails, or any form of spam.
• Fraud: Engage in fraudulent activities, identity theft, phishing, or any deceptive practices.
• Protected Systems Scraping: Use our proxies to scrape, crawl, or access protected systems, websites with anti-bot measures, or systems that explicitly prohibit automated access.
• Illegal Activities: Use our Service for any illegal activities, including but not limited to hacking, malware distribution, or copyright infringement.
• System Abuse: Overload, damage, or impair our API infrastructure or interfere with other users' access to the service.
• Resale Restrictions: Resell or redistribute our proxy lists without explicit written permission.

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of proxy-free.com and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of proxy-free.com.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
• You may store files that are automatically cached by your Web browser for display enhancement purposes.
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

4. Service Reliability and Availability

We strive to provide a reliable service, but proxy-free.com does not guarantee that the proxy servers listed on our website will be available, operational, or suitable for your specific needs. The availability, speed, and reliability of proxy servers depend on various factors beyond our control.

We reserve the right to:

• Modify or withdraw, temporarily or permanently, the proxy servers listed on our website with or without notice.
• Change, update, or modify the Service or any part thereof at any time without prior notice.
• Suspend access to the Service, or certain features of the Service, in whole or in part, for maintenance, updates, or improvements.

We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

5. No Warranty

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

proxy-free.com, its subsidiaries, affiliates, and licensors do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location.
• Any errors or defects will be corrected.
• The Service is free of viruses or other harmful components.
• The results of using the Service will meet your requirements.

6. Limitation of Liability

In no event shall proxy-free.com, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any other matter relating to the Service.

• Your violation of any third-party rights, including without limitation any right of privacy or intellectual property rights.
• Your violation of any applicable law, rule, or regulation.
• Any other party's access to and use of the Service with your unique username, password, or other appropriate security code.

8. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution: In case of any disputes, we encourage you to contact us first via email at legal@proxy-free.com to resolve the matter amicably. If the dispute cannot be resolved through direct communication, it shall be subject to the exclusive jurisdiction of the courts in India.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last updated" date at the top of this page.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

Our Service provides access to proxy lists and related information that may originate from third-party sources. proxy-free.com does not own or operate these proxies and has no control over their availability, performance, security, or reliability.

11. Chargebacks and Service Suspension

Initiating a chargeback or payment dispute without first contacting our support team may result in immediate and permanent suspension of your service. We encourage all users to reach out to us directly at support@proxy-free.com to resolve any billing or service issues before involving payment processors. Please note that we do not offer refunds under any circumstances - all sales are final.
